Summary
These Terms and Conditions govern your use of Digital Control, a workforce time-tracking application operated by Del Portal Technologies S.A.C. (Lima, Peru). By using Digital Control you accept these Terms; if you do not agree, do not use the application. Digital Control is typically used within your relationship with an organization (your employer), which manages your role and membership.
By downloading, accessing, or using Digital Control you accept these Terms and our Privacy Policy. You must be of legal age or have authorization to use the application. Use generally occurs within your relationship with an organization (your employer), which administers your role and your membership in it.
You are responsible for keeping your credentials confidential and for activity carried out under your account. You agree to provide accurate information and not to record false punches, impersonate others, or compromise the security of the application. Notify us immediately of any unauthorized use. Digital Control is a free application; it includes no in-app purchases or subscriptions. We grant you a limited, non-exclusive, non-transferable license to use the application under these Terms. The application, its brand, logos, and content are owned by Del Portal Technologies S.A.C., and no rights over them are transferred to you.
The application is provided as is and as available, without warranty that it will be uninterrupted or error-free. To the maximum extent permitted by law, Del Portal Technologies S.A.C. shall not be liable for indirect or incidental damages arising from use of the application. Nothing in this section limits the non-waivable rights granted to consumers under Peruvian law.
We may modify the application or these Terms; material changes will be communicated through reasonable means. You may stop using the application and delete your account at any time. These Terms are governed by the laws of the Republic of Peru, and disputes are submitted to the courts of the Judicial District of Lima, without prejudice to consumer rights. These Terms are between you and Del Portal Technologies S.A.C., not with Apple or Google.
Del Portal Technologies S.A.C. (Lima, Peru) respects your privacy and processes your personal data in accordance with Peru's Personal Data Protection Law No. 29733 and its regulations. Digital Control works on a multi-tenant model: each organization (your employer) manages its members in isolation. When your organization invites you and you record your punches, that organization also acts as a controller of the work data you generate; we operate the platform and process that data on its behalf.
We use this data to operate the application and authenticate your access; to record and report your work shift to your organization; to validate that a punch occurs within the geofence defined by your organization; to detect compliance events (late check-ins, missed check-outs); to maintain security and prevent fraud; to diagnose and fix errors; and to comply with legal obligations. We do not use your data for advertising and we do not sell it. For support, you can write to support@delportaltechnologies.com.
Under Law No. 29733 you have the right to access, rectify, cancel, and object to the processing of your personal data, as well as to withdraw your consent; you can revoke the location permission from your phone settings at any time. To exercise these rights, email privacy@delportaltechnologies.com.
We share data only with providers that process it on our behalf, under confidentiality and security obligations: Supabase (authentication, database, and backend, hosted in the cloud); Sentry (error diagnostics); and OpenStreetMap, whose servers provide the map tiles when a punch location is displayed (your IP address is visible to that service while the map loads). Some of these providers process or store data outside Peru (for example, in the United States); we apply the safeguards required by Law No. 29733 for international transfers. We do not sell your data or use it for advertising.
We retain your data while your account exists and as needed for the purposes described and to meet legal obligations. We follow a retain, do not erase principle: when you leave your organization, your punches remain as that organization's attendance history. If your organization removes you, we archive your display name so it can attribute those historical records. If you are an organization owner, deleting your account also deletes that organization and its entire history.

You can delete your account from the application, in your profile, or by emailing privacy@delportaltechnologies.com; we process the request within a maximum of 30 days. Deleting your account removes the data that directly identifies you (email, password, and display name), so your punches stop being linked to your identity (pseudonymized) and are kept as your organization's record. If you are an organization owner, deleting your account deletes that organization and its punches entirely.
